Fire Safety Guidance & Regulations

Under UK fire safety laws (see the Regulatory Reform (Fire Safety) Order 2005 in England and Wales and the Fire (Scotland) Act 2005, supported by the Fire Safety (Scotland) Regulations 2006) every commercial kitchen in the UK must be governed by a responsible person i.e. the owner, the employer or any other person who has been designated with such responsibilities. The ‘responsible person’ is legally obliged to show the relevant ‘duty of care’ and act accordingly.

New fire safety law came into force on 1st October 2006 and Part 3 of the Act requires those with responsibilities - such as owners, employers, employees, managers and other occupiers - to take steps to prevent and reduce the impact of fire even if they have never previously held such responsibilities.

The Act states clearly that fire authorities are no longer responsible for issuing Fire Certificates. Under the new Fire Safety Order companies with over 5 employees have to carry out and document a Fire Risk Assessment thereby mitigating the consequences of any ‘hazard’ or ‘risk’.

Due to the high risk of potential fire, grease extract systems should be included in any Fire Risk Assessment as they represent both a fire ‘hazard’ and a ‘risk’ if not correctly maintained as recommended by the BESA (Building & Engineering Services Association). Should the ‘responsible person’ fail to carry out their ‘duty of care’ (as detailed in the Fire Regulations they will be held personally liable for injury or death to building occupants in the event of fire.

Some helpful guidelines, specifically for Fire Assessments related to kitchen grease extraction, are RC 44 Recommendations for fire risk assessment of catering extract ventilation. These can be downloaded from the following link:

These responsibilities also apply to contractors who work on behalf of the responsible person.

In addition further Fire Safety Guidance produced by the government referring specifically to grease extract cleaning in kitchens reads like this

Fire Safety Non Residential Premises November 2016 (Page 27 Item 148)

Generally, equipment ventilation points should be kept clear to avoid becoming clogged or blocked. A build-up of grease or fat deposits should be removed from equipment in kitchens, including extraction equipment.”

Fire Safety Care Homes February 2014 (Page 22 Item 121)

“Lack of preventive maintenance increases the likelihood of fire starting in equipment. Common causes of fire in equipment are:

•Inadequate cleaning of equipment such as tumble driers;
•Allowing extraction equipment, such as in kitchens, to build up excessive grease deposits;”
