Under UK fire safety laws (see the Regulatory Reform (Fire Safety) Order 2005 in England and Wales and the Fire (Scotland) Act 2005, supported by the Fire Safety (Scotland) Regulations 2006) every commercial kitchen in the UK must be governed by a responsible person i.e. the owner, the employer or any other person who has been designated with such responsibilities. The ‘responsible person’ is legally obliged to show the relevant ‘duty of care’ and act accordingly.
New fire safety law came into force on 1st October 2006 and Part 3 of the Act requires those with responsibilities - such as owners, employers, employees, managers and other occupiers - to take steps to prevent and reduce the impact of fire even if they have never previously held such responsibilities.
The Act states clearly that fire authorities are no longer responsible for issuing Fire Certificates. Under the new Fire Safety Order companies with over 5 employees have to carry out and document a Fire Risk Assessment thereby mitigating the consequences of any ‘hazard’ or ‘risk’.
Due to the high risk of potential fire, grease extract systems should be included in any Fire Risk Assessment as they represent both a fire ‘hazard’ and a ‘risk’ if not correctly maintained as recommended by the BESA (Building & Engineering Services Association). Should the ‘responsible person’ fail to carry out their ‘duty of care’ (as detailed in the Fire Regulations they will be held personally liable for injury or death to building occupants in the event of fire.
